“This Stunt Was Expected”

JameisJameis Winston’s attorney, David Cornwell, is firing back after his famous client was whacked with a civil suit yesterday.

The filing by Erica Kinsman comes from an alleged 2012. She claims Winston is damaged here via sexual battery, assault, false imprisonment and emotional distress.

“This stunt was expected,” Cornwell said in a prepared statement. “[The accuser’s] false accusations have already been exposed and rejected six times. This time will be no different. Mr. Winston welcomes the opportunity to clear his name with the truth.”

    And throwing the pick down the drain? Not so fast. Winston can already play, and from what everyone in a football capacity says about him, has the ability to learn to be great at the NFL level, so taking a shot on him, no matter the pick is a worthy investment.

    All these people who continue to assume Winston is guilty have never once read up on the case. They’ve yet to explain why she has changed her story so many times. Even they can’t deny that she was lying about never meeting him before. So she lied about never meeting him, but it is unreasonable to assume she could be lying about being raped??? Uh, ok. Because they don’t like him, they aren’t about to educate themselves, and they certainly don’t want to read anything that might change their mind. If you notice, the haters never dispute any of the facts. Instead, they do the easy, lazy thing- they call him a rapist.

    @Atrain – Just a thought, but maybe she’s not too optimistic about winning the case given her luck so far in court and instead is hoping the timing will damage his draft position so he suffers some form of punishment in her eyes.

    I don’t know if he did it or not but it’s troubling to me that she hasn’t let it go. There has to be some kind of motive for her outside of a payday, if a payday was the goal all along she has probably eaten up a good chunk of what she would receive in legal fees. Something just ain’t right about the whole thing.

    best qb to come out since luck? I don’t know. Teddy has been the best since luck. JW is not a slam dunk. Hopefully sloppy footwork at times gets corrected. He forced and was inaccurate at times. This isn’t elway or luck. He will need time to develope for sure. Its going to be very hard for him because he will have a below average line, and that really sucks. His weapons are a bit limited bc vj and evans have a like skilll set and we don’t have great backs. I’d say trade for ap, but he is too old , expensive, and we can’t afford the picks. It will be winston, but it may not end well. Cosell said if mettenberger and teddy were on the board, jw and mm would be going late 1st early 2nd. Its always hard when you have a huge need and you look at the top 2 in the class… you might not realize the class isn’t very good

    bill cosby’s lawsuit where he is accused of slipping something into women’s drinks and having forced sex has turned into a class action lawsuit. I think 50+ women are involved. Winston’s suit will probably go class action. even if many of these women are nothing more than $$$ seekers it will be covered by the media and I don’t think the bucs would want that kind of negative publicity. I don’t think this guy is in the bucs future in spite of what they are saying to the media. I was watching espn sportscenter and Hannah storm was discussing this with an expert. he said Winston would have to agree to having what amounts to an adult babysitter if the bucs drafted him.

    I’m not saying Winston is guilty, nor am I saying he’s innocent. What is sad is that we will never know more of the facts since the Tallahassee PD and FSU did a piss poor investigation, so the evidence was lost. This evidence could have proved Winston innocent, or guilty, but we will never know. But, I do believe where there is smoke, there is fire. It makes more sense that this was a cover up, then nothing happening at all. Winston has had several off field incidents, there is another woman that may also sue him, and, in the mean time, Winston has a girlfriend that i guess doesn’t mind him screwing around. I just rather the QB may their headlines on the field, not off it, therefore, i hope the Bucs pick Mariota, Winston is just bad news IMO.

I acknowledge his character is a bit troublesome, and I don’t blame anyone for wanting to go a different direction.     I can still think things seem odd, that’s my opinion. I still don’t see a real motive to drag this thing out the way it has been if she didn’t feel like she was harmed in some way. Reports are the suit is for roughly 15k in damages, which isn’t small change, but it’s hardly a “payday” that warrants 2-3 years of court appearances, having to change schools, hate mail and anything else she’s had to deal with. Things just don’t add up to me.

What do you think they did? I go to Tallahassee for business and I can tell you that the citizens of Tallahassee feel that this was a cover-up, so I believe them. If the second girl comes forward, that will be the end to this. The Bucs have a big decision to make, which will not only effects the team, but the Tampa community.     Here’s what worries me so much about this….There is a huge difference between civil and criminal court…Especially when it comes to burden of proof. In criminal court the defendant must be proven guilty “beyond a reasonable doubt” but in civil court only a “preponderance of the evidence” is needed to assign guilt. Maybe Winston is innocent, but he still runs the risk being found guilty. If he is found guilty, what will the NFL do? Will he face a lengthy suspension? Will the Bucs be forced to admit they drafted the wrong guy? Will the team’s reputation suffer because of it? Will all of this be a huge distraction for Winston and the Bucs? When Erica Kinsman takes the stand, and it is carried on the nightly news on every network, will it overshadow everything the Bucs are trying to accomplish this year? And maybe the most important question (for Lovie Smith)…If I went 2-14 in my first season, and feel my seat heating up under me, do I REALLY want or need this kind of distraction following me around all season and hanging over my career? So many questions.

    I will return to my original position and offer another option….draft Mariota and build around him…..or trade the pick for Philip Rivers and the Chargers first pick! He would give us a top 10 QB for the next 4-6 years and get us back into the division race immediately! Trade Martin and a #2 next year for AP. spend the rest of our draft picks this year on shoring up the offensive and defensive lines! We would be back in the playoff hunt like that!

    Here’s the thing. At the COC hearing, it was the same threshold (50%), but, she had no fear of deposition and cross examination by a defense atty. And she lost that.

    Now, she can be questioned by a defense atty and have them enter evidence against her. COC hearing was her absolute best chance and she lost.

Having a cloudy memory of things does not make one a liar. Are there inconsistencies? Absolutely, but this is not unusual for a woman who has been drinking. This is even more common for victims of rape. To be fair, there is not enough evidence to support her claims either, but if you want everyone to give Jameis the benefit of the doubt you must do the same for Erica. The fact that anyone would list her description of his height as a lie proves only that they are only looking for things they can call lies and not reasonably looking at the evidence.

    Whether you think it was a cover up or not, you must accept the fact that it was a poor investigation at best. TPD made no attempt to discover the identity of the accused. Her report came immediately after the event. At that point they had the opportunity to get evidence that was never collected because they waiting too long. Had they investigated properly they could have actually helped Jameis if he was falsely accused.

Was it held in civil court before a jury? Juries do strange things sometimes. I’ve heard people say there is only circumstantial evidence on her side…but people are convicted in criminal court on circumstantial evidence all the time. Aaron Hernandez was just convicted of murder on circumstantial evidence!

    Obviously this girl is willing to put herself on the stand and testify that she was assaulted….if she wasn’t, she would not still be pursuing this action (I’m not saying that I believe her). It will be all over the news! It will be all over ESPN! It will be a distraction on some level! What if this “2nd accuser” comes forward? Will that not be a distraction too? Does Lovie Smith want or need something like this as he tries to rebuild a 2-14 team and keep his own ass out of the fire!

    Why is this girl still doing this is the big question, isn’t it? If she is lying, she may be committing perjury and setting herself up for her own legal problems….so knowing that, why is she doing this?     She is the only one in the entire case who has repeatedly changed her story. I hope they proceed. It will get ugly. Fast. For her.

    The entire COC transcript is public record and I have read it. She denies claiming to be drugged at the hearing. Then, in the documentary, she turns around claims to be drugged again (LOL). This will all be submittable in court.

    Not necessarily. Her attorneys could be hoping the bad PR forces him to make a settlement during pretrial. If they don’t, they have the option to drop the case. This is a Hail Mary. I highly doubt the case will get to the point where she could be deposed by a Winston defense atty (he could hire some of best money can buy).
