Joe doesn’t expect this old news turned new news to alter the smiles at One Buc Palace

UPDATED 6:50 p.m.: Yes, Jameis Winston, the prospective Buccaneers quarterback, is officially an accused rapist once again.

The expected civil suit from Erica Kinsman, the former Florida State student who alleged Winston raped her in 2012, arrived today. Per Matt Baker of the Tampa Bay Times, a suit was filed in Orange County “over claims of sexual battery, assault, false imprisonment and “intentional infliction of emotional distress arising out of forcible rape.”

So now what?

There’s a zero percent chance Winston tries to settle out of court before the NFL Draft, which is in 14 days.

For those just starting to pay attention, the Bucs and the free world know all about this case. Winston has never been arrested for rape, will not be charged by the State Attorney, and was cleared by his school. Winston says it was simply a consensual encounter. The details of the alleged victim’s story are messy at best.

ProFootballTalk.com notes the lawsuit references an alleged second person who accused Winston of rape. “On October 25, 2013, Plaintiff’s victim advocate at FSU informed her that a second woman had come forward and reported being sexually assaulted by Winston.”

This second accuser also is nothing new to the story, assuming it’s the same “second accuser.”

Joel Glazer, proud member of Team Glazer, told Joe at the NFL Owners Meetings that the Buccaneers are very comfortable making Winston or Marcus Mariota the face of their franchise. Glazer cited deep research into both young quarterbacks, including face-to-face meetings with ownership.

Joe doesn’t expect cold feet for Winston at One Buc Palace, but you never know.

    This is beyond predictable, especially if you actually read the details of the case. I’ll be completely honest, before I researched this case, I thought he was guilty. I unfairly labeled him guilty without any knowledge of the case. I believe I may have even called him a rapist in a post towards Buc1987. I was an idiot. As I became more educated, I saw how ridiculously weak her case was. Now maybe he did do it, but the evidence sure doesn’t point that way. Aside from her word (against his), there isn’t any proof whatsoever of a sexual assault. Now this girl appears to be looking for her pay day. Now cue the same Winston haters to pile on. We all know its coming.

    No Way are we taking him now…. I hope I’m wrong, because I believe the kid can be a special quarterback, but the entire organization is gonna take a tremendous amount of heat if the select him #1.

    This is gonna make me sick if we take Mariota simply because of this latest lawsuit, which could be nothing more than a giant money grab. I’m not saying it is, but the timing seems awful strange. If she waits, she could get a bigger settlement, but by doing it now she’s laying some real hurt to the start of his NFL career.

    The problem I have with that is that I can accuse anybody of anything and not have sufficient evidence. Does that make them guilty of my false accusations? At what point can the accused prove that the accusations are false?

    leonard Williams is the best interior defensive lineman in the draft. he uses strength and power not speed. he can play many positions on the d-line. he is best suited for a 3-4 defense. his lack of speed does not suit well on the edge. watch his tape from the nfl combine he was very slow. the best edge rusher in the draft is from Nebraska randy Gregory. he has failed numerous pot using drug tests including one at the combine and is probably going to be suspended several games in the nfl. he also might need rehab. that leaves the best trouble free edge rusher the guy the bucs brought in a couple of weeks ago dante fowler the florida gator.

    Says, Willie Meggs, Florida State Attorney: “he (Winston) was not exemplifying great character that night, no matter what the facts are.”

    About the investigation he said, “Anybody, as my daddy would say, with one eye and half-sense knows there are some things that needed to be done that weren’t done (by law enforcement),”

    He continues (with WanstaStayaBuc replacing “FSU” with “Bucs” and “student” with “fan”):
    “I don’t hold out a ton of hope that anything is going to be done with this federal investigation,” he said. “It is a decision the Bucs has to make about who they want playing football and who they want for their fans.”

    You need to learn the difference between being “cleared” and not being charged. The first “CAN” occur after a trial of one’s peers. The 2nd happens when there is not enough evidence. Dude, Joe has been an employed journalist at a major newspaper with responsibilities that included covering court cases, police reporting and other civil matters. Joe knows the difference. Perhaps you don’t, considering below you reference being “convicted” in a civil trial, which is not the correct language. –Joe

    Now before the Winstonites come for my scalp I’m simply pointing out facts here not saying we shouldn’t draft Fameis, just that we should do so with open eyes.

    And so O.J. was actually cleared in a criminal court of law. Then he was convicted in the civil trial that followed.

    If Fameis does not settle this out of court and it goes to a jury then ANYTHING can happen just as it did with O.J. Everybody better hope that Kinsman is in it for the money. If she’s in it for real because she thinks she was wronged and now wants to “clear” her own reputation and forces this to a jury trial it could get truly ugly.

    And so what would happen if it actually makes it to trial, wouldn’t take place for a long time, maybe right during the playoffs. What if the second woman testifies and it’s played out on the network news? What if a jury finds that Fameis did rape her?

    The weight and presentation of evidence will be different. The rules of engagement which totally favored Fameis in any criminal accusations certainly shift.

    And so a simple question. IF it goes to trial and Fameis is found guilty there would be no jail time just a financial award. But he would then be known as a “rapist” . Have any of you thought about that possibility and if that should happen are you still cool with having Fameis as the face of the franchise?

    Unfortunately the investigation wasn’t as good as it could have been….Winston would have been better served if it was. The destruction of the tape could have exonerated him, for example.
    Now, he will always stand accused, perhaps of something he didn’t do. There is no way for him to proove he didn’t.
    Going forward, he is a marked man and will have to be extremely careful with all of his relationships. He will likely be accused again…such is the nature of someone with fame & money added to a reputation for bad acts…even if those bad acts never occured.
    Buc fans will constanly be defending Winston….I just hope he is worth it…and proves worthy of our choice.

    Exactly. Winston is a great prospect and I really wish he never had any of these issues. Would be a much easier decision then. We all forget this is a kids game. More kids play this game than adults. The most important part of this sport is teaching discipline, respect and working as a team. The people who grow up and are fortunate enough to have the skills to play proffesionally need to make sure they’re setting an example for the youth. Lovie Smith and Gerald McCoy are great examples of that.

Maybe you still take Winston if you’re damn sure there’s nothing to this case (and possibly the other they referred to), but then you start to worry if fighting this case (or cases) will be distracting to a rookie QB and the team that takes him? It’s very disconcerting. I’m all for Winston being innocent until proven guilty…BUT will this now become a huge distraction that makes selecting Winston counterproductive? I also wonder about this…IF Winston were to lose the civil case (and the amount of evidence need to convict in a civil case is LESS than what’s needed in a criminal case), would he be subject to disciplinary action by the NFL?

    This makes me VERY nervous. If the Bucs are determined to take a QB at #1, Mariota may be the safer choice, even if it takes him a little longer to get his feet under him.

    The problem with this is that the accuser doesn’t seem to be satisfied with anything less than a settlement or actual trial…..and we have no idea what sort of evidence is available to her.
    There may not be enough evidence for her to win….but it could be real ugly evidence and a PR nightmare for Winston. Who knows?
    With this suit and the Title 9 suit against FSU….there will be news on this subject for months….perhaps years.
    It may be a distraction that the Bucs are willing to accept….but distractions are usually avoided by NFL teams if possible.

    I agree. Certainly Fameis appears to be the real deal. I’m not as down on Mariota as many on this board however.

    I tend to go with the prevailing consensus. Fameis is ready now and Marcus may need some time. I wonder however if the style of play isn’t coming to Marcus.
    New rules in the NFL protect a mobile QB and encourage offense and not defense.

    Having said that I’m not concerned about Fameis mobility. He’s slow but he’s slippery and can also move in the pocket.

    For me the bottom line is that BOTH of these young men are excellent prospects. I simply do not see either QB’s supporters as morons or any other pejorative term.

    Some pundit on either ESPN or NFL Net summed it up for me. This could be a draft like the one that produced Matty Ice and Flacco. Both QB’s are good and that could easily happen with Fameis and Marcus.

    First, the timing. I think we all expected it to hapen AFTER Winston got his draft money.

    Second, I only just heard of this, and channe 10 cbs is saying she is seeking $15,000 in damages. That is NOT a payday. In fact, it looks more like she just wants her day in court.

    As far as the lawsuit itself, I’m not holding it against him because one was expected. However…

    And It also said that Winston could not be charged criminally because of insufficient evidence. So the ability to put Winston behind bars doesn’t seem to be there. So what else is left? $$$.     We got to pass on Winston. I’ve been on the Winston bandwagon for the past couple of months. He is extremely confident (which I love) and he has a cannon. But lawsuits like this makes him a target for the rest of his life. I think we are nuts to bet on this guy when Mariota is right there with a clean track record. Mariota is extremely fast, a good size and very accurate. The fact he only threw like 13 picks in his collegiate career is nothing short of amazing system or not. The only knock is that he doesn’t know the pro nfl system. But he scored a 33 on that test. So surely he is is smart enough to learn the system. I think both Winston and Mariota are going to be good but the same bet is on Mariota because he is 6’3 and extremely fast. We know he’s gonna be better than Kaepernick. The media is a crazy smokescreen! The bucs need to take Mariota.

    The crazy part is that I actually want to believe her because rape is very serious and I can’t see how any girl would want to make up something like that. But now I really find it hard to believe because of where she has taken this thing. Regardless, no one will ever know for sure what really happened that night except her and him. Which is why I never wanted to get involved with this in the first place. Before today, I don’t know much about this case and I really wish it would have stayed that way.

    I gave my friend a call, an FSU undergrad but a law graduate of reputable northeastern status, and sought some legal clarification….albeit, very unofficial. His response was interesting, basically saying the burden of proof in civil cases is very similar to that of what the Title 9 investigation was.

    There is a strong probability that this civil suit will produce the same result that the title 9 investigation did.

    How about that timing? Reminds me of how sleezy politicians sometimes operate – releasing some type of late “October surprise” manufactured dirt on an opponent to influence the pending election.

    This is nothing more than vindictiveness. Erica and her legal team have been playing the media and the uninformed public at large like a fiddle since mid 2013. What is truly insane is that it works on so many. Just like the numerous people on here saying something along the lines of – “I was on board with Winston – but NOW we definitely shouldn’t take him…”

    Why. What’s different? Everything about this is 2 1/2 years old. There is nothing new here. It’s just the EK team dredging up the false accusations time after time after time in order to hurt Winston in the “court of public opinion”. She wants to hurt his public image as badly as she can and then try to get a big payday.

    And since so many people are ignorant of the facts in this case – she is succeeding in negatively influencing Winston’s image.

    But she will NOT get paid – and in fact is taking a BIG risk with this action. If this makes it to trial (which I hope it does) – Winston’s lawyers are going to expose her big time for the lying, money grubbing, cleat chaser that she is.

    Off the top of my head I can name at least a half dozen major lies she has told regarding this matter. Lies proven via direct evidence that are central to the case and once fully exposed via cross examination (which she has never had to undergo) – will show beyond any shadow of a doubt that this rape accusation is completely bogus. I have detailed all these lies before as have others – so not gonna waste my breath doing that now. But it is sooo sad to see so many here and probably everywhere have their opinion of Winston negatively influenced by the timing of this civil suit announcement.

    Bottom Line?

    None of this matters. There is nothing new here. The Bucs know every detail about this that can possibly be known. And they are comfortable with the facts and comfortable in knowing that Winston is not a rapist and is not a “character risk”.

    Winston will be the Bucs new QB. Nothing has changed.

    And for the idiots talking out their a$$es in light of this “latest revelation” – put your $ where your mouth is!!! Name the amount of the bet. I bet on Winston as #1 pick to the Bucs – you can have the field.

    Any Takers? I hope so – but surely doubt it.

The play is simple, this is the last opportunity that EK has at a settlement and shes taking her shot. Kudos to her? I guess? The problem is that the leverage she would normally hold is that of damaging JW’s reputation. Anybody with internet access knows that has already happened. Winston has nothing to gain by settling with this woman, so he won’t, nor should he. It will be a 5th consecutive ruling in JW’s favor…..

    Consider this. What if she was actually raped?

    I’m not saying she was, but in order to understand, let’s consider it for a moment. If she was actually raped, no one has believed her. You sit there, you look at the evidence presented, and you listen to the media, the ignorant and such, and you choose not to believe her.

    Maybe her story has changed slightly. It happens when a person is recalling things that happen during stressful ordeals. We all know, the smallest variance would be exaggerated by the media. After all, they do it to everything else.

    So, still assuming for a moment that she was raped, then when she put her trust into the college to believe her, they didn’t. Then the judge didn’t. She, a victim of rape, has been lambasted by the fans of Jameis Winston. By practically every FSU student. By most of the people here even.

    Take the reactions here. People are not considering that she is a victim, but that she is a gold digger.

    But I ask again, what if she was actually raped?

    Put yourself into her position. This player, Jameis Winston, is getting away with things that he should not. She cannot get true justice, because it is her word against his. What recourse does she have?

    You cannot understand this because you have to put yourself in her shoes.

    It’s like someone in chronic pain. Pain is not visible, so the people around you have no reason to believe it’s as bad as you claim. But it is horrible. If there came a way to get validation, to prove your pain in some way, you would leap at it. Just to show others that you are not making excuses, faking it.

    In her case, IF she was raped, no one has believed her. Validation through a civil suit is the only form of justice left to her.

    Again, I’m not saying she was raped. I’m understanding that people can misjudge her motives. Maybe she made it all up, and maybe she didn’t. But what is disturbing to me is people’s rush to blame the victim.

    All because Jameis is Famous.
