Tampa Woman Makes Bizarre Money Grab At Talib

The latest in the Aqib Talib saga seems so preposterous Joe almost feels stupid writing about it. But it is about formerly helmet-wielding, cabbie-slugging, allegedly gun-toting Talib, so how could Joe ignore it?

Roy Cummings of The Tampa Tribune is reporting a Tampa woman filed a civil suit against Talib for $15,000 claiming she and Talib had a car accident and she suffered physical injuries and emotional distress related to him threatening that he’d “put a cap in” her at the scene. The accident allegedly happned in December 2010.

Ready for the punch line? There’s no police report on the incident to be found. (See update below).

Tampa police have no accident report from the alleged altercation and couldn’t verify that a traffic accident occurred on that date when contacted Thursday by The Tampa Tribune.

Joe can only imagine what this lady would be suing Talib for if he threw in a few fat-ass jokes or called her a ho.

Joe will serve up more on the legal aspects of this case tomorrow.

UPDATE via ProFootballTalk.com: Talib’s laywer has released a statement.

“Fifteen months ago, on December 9, 2010, Aqib Talib was involved in a very minor traffic accident involving Betty Atwood,” Reisinger said.  “Ms. Atwood placed a 911 call to report the accident, and was also interviewed by police at the scene of the accident.  At no time during the 15 months since the accident has Ms. Atwood ever reported this alleged statement to the police.  Further, we have witness statements confirming that Aqib never made a statement of this nature toward Ms. Atwood.   Following the accident, Ms. Atwood discovered that Aqib played for the Tampa Bay Buccaneers.  In order to leverage a substantial monetary settlement, she concocted a tale to increase her alleged damages.  Aqib is evaluating his legal options with respect to this false allegation.  Aqib is confident that once all of the facts are known, this matter will be resolved favorably and in an expeditious fashion.”

Joe stands behind the assertion in the headline that this is a bizarre money grab. It’ll be interesting to see the details as they trickle out. And Joe will have more tomorrow on the legal aspects of this case.

    I know a lot of people don’t like Talib, and he has been in legal trouble before, but this is ridiculous. The police have no record of the accident to begin with so this will get thrown out very shortly. This is just a definition of someone with trouble past getting picked on so some bum can make a few bucks.

    First, not all and fewer and fewer car crashes are investigated by police due to limited law enforcement resources.

    Second, it is standard to make your claim to cover both physical and emotional injuries, and the $15,000 threshold is the minimum requested amount for the circuit court to have jurisdiction, as opposed to the county or small claims court.

    Third, the civil case would go nowhere if there is no police report and no credible eyewitnesses to support the claim. I would bet dollars to donuts that if there was no report to police that there was an insurance investigation documenting all physical and testimonial evidence.

    Fourth, read P F T, Talib’s lawyer said that she called 911 about the accident, so it apparently it was reported.

    Finally, does anyone believe for 1 second that Talib didn’t say that to her? Of course he did. I am not saying that she is emotionally distressed by his threat but, if she was physically injured the claim could easily exceed 15,000 in value, which I am sure he had auto insurance for – if not well then he is an idiot. Which he is.

    I seriously doubt that Talib or his spokesman attorney out of Pittsburgh has a copy of every statement made by Atwood to police, insurance and private investigators over the last 15 months. If she was asked questions over that time that should have elicited this info and she didn’t provide it, and there are no credible eyewitnesses to corroborate it – she will have problems.

    The odds are very strong that this thug said that to her.

    Thomas- well said. Contrary to what many believe, you can’t just walk into court and sue someone- because they are rich. There is more anemone corroborating information , to confirm the incident occurred. And if this woman has retained an attorney, and filed the motion to sue- then you better believ they have witnesses to futher corroborate her story

    Futher- if you still don’t believe that Talib probablyis guilt of this, you probably don’t believe
    1) he attacked Cory Byrd at the Rookie symposium
    2) he smashed Torrie cox in the face-while swinging at our pro bowl LT, requiring Cox to get surgery
    3) he Slapped a Cab driver in the head- whle he was driving- cause he ” thought it was funny”
    4) He had to be restrained from attacking NFL referees, in the tunnel, while coming out at half time!
    5) He brought a gun to his mothers house, and the two of them took turns shooting at his Brother in law

    Sadly- I bet I forgot a few incidents. If you don’t believe any of this happened- you are in desperate need of a moral center, and a good psychiatrist.

    When will this team finally have enough of this idiot, and terrible CB. It’s jut embarrassing to be a fan of this team, with idiots like this on it!

    They got plenty of police officers to make a report of someone threatening to put a cap in someone. As a matter of fact a cop could lose his job for not making such a report.

    She claims this was done after the accident but before the police arrived. If that was true, there would be a report of both the threat and accident.

    Also, either Talib or the woman would have gotten a citation, and Hillsborough clerks records don’t show one for Talib or the woman.

    Not buying it. Don’t add up at all.

    Not to mention spruce and westshore is pretty darn busy, hard to imagine such an occurance with nobody seeing it and the police not reporting it.

    You are dead wrong the about citation. I have been involved in many cases, I would call it common, involving car crashes where for various reasons neither driver was cited.

    I have also been involved in cases where it was difficult or took inordinate time to locate the police report. Additionally, it is not uncommon for us not to be able to locate a citation in the clerks public records database due to spelling erros and other omissions.

    Actually, BKNY, I care about his morals and I’d rather have him cut than play good football (which he occasionally does for the Bucs). Not a guy I want to cheer for on Sundays and it’s really hard to cheer for the team I am a HUGE fan of minus a player or two. Much easier to cheer for the whole team.     This may come as a surprise to some people after I defended Talib so sternly last year, but I do believe this off season MAY be the time to cut him. Not because of this silly thing (pinch me, but I think Thomas is right that a police report will turn up)…but because of the time remaining on his contract and his pending legal charges/likely suspension.

    If we get a CB in free agency that has a hint of talent and actaully get Mo in the draft, then Talib should be cut. Biggers should be cut too…simply because is doesn’t give enough effort.

    Jason Cole of Yahoo! Sports reports that free agent cornerback Cortland Finnegan is actively “recruiting” free agent wideout Vincent Jackson to join Finnegan on his next NFL team. Cole suspects that team is the Tampa Bay Buccaneers.

    I think this might be made up because of the recent interview, but if true, I like! That interview won me over on Finnegan.

    OK, everybody spend the rest of the evening either supporting Talib or condemning him. Makes no difference either way. This is just a conversation piece. What Talib said has no merit in a civil case. People argue all the time at the scene of an accident, even call each other names. Talib could accuse the plaintiff of calling him a racial name. It doesn’t matter. It is not material to the accident. It would be an issue if a crime had been committed, ie, assault. But no crime was reported at the time and will not be charged now.

    Now for the law. There have been no criminal charges filed for assault, assault with a deadly weapon or even a complaint filed for such at the time of the incident. This is a civil suit for damages in an auto accident. For all intent and purposes, Talib will have no involvement. This will be handled and settled appropriately between insurance companies. It is not enough for the plaintiff to try to recover losses for stress or stress-related injuries. Medical documents, related treatments, and reasonable actions taken by the plaintiff as a result of such stress must be substantiated. This will go away as fast as it appeared in the news!

    Since there have been no complaints filed with the appropriate agencies other than in the unsettled civil suit, This will be treated as hearsay and will not be allowed to prejudice Talib in the Texas case. At this point, it is he said, she said!

    Oh, before I forget – for all of you who say you couldn’t file a lawsuit unless there was merit, Wrong! The next time there is a tainted lettuce scare, go to your local market and buy a head of lettuce. Eat it on the way to the emergency room complaining of stomach cramps, vomiting, and diarrhea. They will treat and release you. Then call Thomas and, voila, lawsuit. You can sue a ham sandwich. You just won’t win!

    Now for the court of public opinion. This should in no way affect the Bucs recent desire to give Talib a chance to move forward.     We didn’t. He shot at his brother in law. Then he started at CB. He was the starter for 9 of the 12 losses. He sucked. Raheem actually started putting Biggers on the Number one WR. We lost like there was a prize for worst secondary ever

    And here we are again. Is this allegation true? We dont know. But we’ll know more in the coming days. With this guys attitude and total disregard for laws, teammates,and intelligent behavior- don’t bet against it.
    But even if it’s BS, why would this idiot allow himself to be in his position.?

    The Bucs supposedly have a simple schedule this year. Do you think that means they might do very well? I think it MIGHT.

    It’s a bit early to make such a prediction, but it sure “seems” like the cards are lining up for a last-to-first result again in the division. I think Cam is overrated, and teams will figure him out this year.

    The Saints offense is what wins their games, but suspensions and a Drew Breeze hold out, plus losing Nicks, Colston and a slew of other players in free agency will set them back.

    That leaves Atlanta as our strongest rival this year.

    So I think Schiano might come out looking like a genius this year. We’ll end up with a stronger schedule the following year and might lose more games…it will depend on how well the team develops.
