Talib’s Defense: I Didn’t Shoot

It seems Aqib Talib’s legal team might go for the homerun defense, which in Talib’s case would be to claim he didn’t fire a gun at the dude who allegedly was harrassing his sister.

Not self defense. Not temporary insanity. Just unabashed innocence on the felony assault with a deadly weapon charge that has rocked the Bucs.

Rick Stroud, of the St. Pete Times, dished out some details on newly-formed Team Talib preparing to bring its artillery into Texas court.

Talib has retained noted Pittsburgh sports attorney Jay Reisinger, a member of the legal teams that represented Alex Rodriguez, Sammy Sosa and Andy Pettitte. He also has hired Dallas criminal attorney Frank Perez and H. David Lozano, a private investigator of Drake Security Patrol.

Although Talib’s attorneys declined comment Wednesday, privately he’s been adamant that he did not fire a weapon during the domestic disturbance. Talib told Clint Bowen, a co-defensive coordinator during his career at the University of Kansas, that only his mom pulled the trigger.

“I talked to Aqib two days ago,” Bowen said. “I told him, ‘I just read something about you firing a gun.’ He said, ‘Man, I didn’t do a thing. It’ll all come out soon.’ He just kept saying that…He said, ‘I didn’t do that. That was my mom. It’s all going to come out.”’

Isn’t this interesting. As Joe wrote previously, Talib could very well become a sympathetic figure from this case as his legal team paints a picture of a man protecting his family from a dangerous sleazebag.

Now if there’s not enough evidence to prove Talib used the gun — that doesn’t mean he didn’t — surely Talib will be a playmaker on the field for the Bucs next season unles Mark Dominik and Raheem Morris have crafted a radically new discipline policy.

    Well now, isn’t this an interesting development?

    IF Shannon Billings is the states main witness, and both Talib’s mother and sister give statements that Talib did not fire a gun, then the most he could face charges for is assault (for hitting the man with his own gun), and on that he can plead self defense.

    What I’m curious to know is this:
    Will everyone here and in the media automatically assume this latest news is all a lie, or will they actually give Talib the benefit of the doubt?

    What is he’s telling the truth?

    If he is, it would make sense that he hire H. David Lozano to investigate the claims any witnesses are making.

    If this proves out to be true, a lot of media guys are going to look like total judgemental arses. They will have reported unsubstantiated news and condemned a man when their own assumptions were based on lies and unsupported facts.

    I bet no one saw this one coming 😉

Even if he hadn’t fired the gun, he’s still a magnet for these kind of unsavory events. How can he be a dependable leader for the Bucs if he can’t even convince his mother not to carry a gun, whereby violating her felony probation?

    Even if he gets off, which I hope for the Bucs’ sake, he does, Talib’s issues still need to be discussed.

    Honestly, when is the last time you were able to tell a parent what to do? Just as Raheem is not responsible for the actions of his players, neither is Talib responsible for his mother’s actions.

    And, all those media guys did assume guilt. They were not suggesting Talib be cut before this incident. They insisted because of their assumptions of guilt.

    Not once in previous days did I hear or read one of them say, “If these charges are true, then the Bucs should…”

    No. They automatically assumed guilt and insisted the Bucs cut him. Heck, I even heard certain members of the media insult Talib based on their assumptions.

    And not once did any of them even consider the possibility that even if true, Talib might have been justified.

    Maybe Talib is innocent, but he is still guilty by association, and stupid. He never should have put himself in that situation to begin with. He has so much to lose and didn’t think it through. He could have easily given “Big Mama Thug” an envelope full of cash to hire some not so local “Gangstas” to do the dirty deed on Billings. Let things cool down a bit, then strike.

    Look, I get the fact he was coming to his sisters defense, but pistol whipping and shooting at someone (still no definitive proof he didn’t?) are WRONG and ILLEGAL! It wasn’t like he just happened to be there and all of sudden he was thrust into some sort of non-consciousness thinking. He drove there and had time to think it out. I don’t care if he pulled the trigger or not, it was on his mind, cause he pulled the gun (ie tried to pistol whipp the Billings). The only time you pull a gun is to use it, period!
    With that said, I do agree, he shouldn’t be released unless charged. But, his repeated thug attitude needs to be addressed and controled.

    “WRONG and ILLEGAL” would only apply if it were not self defense or in defense of his mother and sister.

    At the point when it is claimed Talib shot at him, Billings was “running away with Talib’s gun”. What if it comes out that Billings had turned and raised that gun as if to fire it at them as he ran?

    That would mean self defense.

    And then you have the property issue. Billings had Talib’s property (the gun) and had tresspassed. In Texas, it is LEGAL to shoot someone under those circumstances, even if they are fleeing.

    Billings had a restraining order and was in voilation of it. For all Talib knew, Billings could have been armed.

    There goes that assumption of guilt again.

    Some might feel it’s wrong to assume Talib is not guilty. To them, I would point to the right to be innocent until proven guilty. The assumption, by constitutional right, is not supposed to be of guilt, but of innocence.

    Regardless, of what happens, the Bucs can not cut him because he is not legally under the auspices of the NFL and the Tampa Bay Buccaneers at this point in time. I have had a situation similar and yes I took my gun to my sister but I calmly walked in the house, told the idiot “I am armed and I expect you to leave and her to leave with me. I didn’t come to fight or argue, I came to remove her from this situation.”

    Now the real reason I didn’t pull my gun out is because not only am I living for my 3 kids but if I am locked up and put away, after the emotions wear off she can go back to this fool and start screwing him again while Bubba is watching me…

    Now I don’t earn nearly the wage that Talib earns for a living but I identified a greater cause, even though I armed myslef for that cause also to protect my family just in case. But this crap is following him you cannot tell me that as a lover of the Bucs you cannot tell me that you want to this negative pub every year?

    Stop defending his decision making and hold him accountable. I am sure he will get oof some sort of way but its all about time not if remember. I am not one of these delusional fans saying Lewis and Biggers can make up for losing him but I am saying that the Bucs must move now!     In regards to your argument, I agree. I’m not interested in playing the “What if’s” when the characters are: Talib, his gun-toting mom Okolo, and this womanizer Billings. To be honest, society would be a lot better off without the likes of all 3. It would be nice to have this event somehow not affect the Bucs and Talib, but even in that unlikely best-case scenario, the Bucs have to question Talib’s critical thinking skills or lack there of. You can’t depend on this guy. He’s got more talent than Ronde and Brian Kelly. But you could depend on those guys.

    I hate to see him go. But that’s what winning franchises do (see Steelers with Plaxico and Holmes). NEXT.

    Except that in my case, I am following the very foundations this country were built upon. I am merely upholding the right to be presumed innocent until proven guilty, as is Talib’s constitutional right.

    In the scenarios, I was pointing out various possibilities that could be the case. I did not make the claim that Billings did indeed do that. I said “What if?”

    In your case, there is no “What if?”

    You’ve already made up your mind.

    Once again, you are saying I made a claim that I really did not make. I said no one should judge until all the facts are known. In no way at any point did I say I knew all the facts.

    Really, Oar, I fail to understand how you cannot understand this. Surely you are not a child or you would be in school. You are able to write and spell, so you are not uneducated.

    So I can only assume that if you were accused of a crime, booked and released on bail, you would want everyone to just forego your trial and assume you are guilty?

    No…I doubt you would want that, because then you would be held to the same standard you use to judge others.

    And I don’t mean that as an insult, I truly do not. I am merely attempting to clarify my point by giving examples. My hope is that you and others will understand that.

    Yes, Talib might be guilty. Maybe Billings is completely innocent of any wrong doing and is truly the victim.

    But by the same token, maybe it is the complete opposite. You should be able to understand this.

    For example, one time I was walking along Nebraska Avenue carrying my Bible and a tap player which was playing Christian music (this is years and years ago). I was not paying attention to my surroundings until I sensed movement as I crossed a side street.

    As it turned out, a group of people from a house party down that street had been exchanging words with the people in a bar on the other side of Nebraska. I just happened to walk between them right when they were walking out to get in a massive street fight.

    Next thing I know, the people from the house party were attacking me, assuming I was a part of the other group. I defended myself well enough, and they eventually backed off after I made it clear I would not go down easily.

    The people from the bar had backed down completely and fled back to the bar.

    So…had the police been called, when they arrived they would have seen three men from the house party lying on the ground injured (one unconscious) and five others bruised up and regretting their actions.

    I was outnumbered in that case, so they would have been able to claim I had started it all and I would have been arrested.

    So tell me…would you have assumed that I were a guilty man?

    This is a true story and clearly illustrates my point. Hopefully, you will see that sometimes the truth does not come out until later, and that is why people are assumed innocent until proven guilty.

    Are you the same guy who called up Steve Duemig yesterday and said that Garland PD is no stranger to the Talib family and then consequently were made to look like an idiot when Duemig interviewed the a representative of Garland PD and said that that claim is unfounded. That Talib had a minor brush with the law in high school but it was not a major issue.

    Or did you just hear that guy while streaming Duemig’s show??

    Sigh…I am not saying peoples opinions do not count and should not be expressed. I am saying that those opinions should be qualified with a complete understanding of the true situation.

    I can agree that if Talib is guilty as charged, he should be suspended for at least a year and the Bucs should consider cutting him. I can also agree that there might be more that we don’t know about, and so rash judgements would be unwise. If the Bucs were able and did cut him right away, then later found out that there was much more to the story and the charges were dropped, they would look like idiots and we would be out a good player.

    I’m all for making examples of guilty parties…I just think we should be 100% sure they are guilty first.

    There are two things you simply for whatever reason fail to grasp:

    1. Roger Goodell is going to suspend this guy, no matter what a Texas court decides.

    2. You seem to be quite confident that Talib will never, ever have a run-in with the law again. What in his personal history suggests that? If anything, as Joe has documented, his incidents grow worse and more violent.

    1. I have no doubt of that. So I do grasp that point. Even if cleared of shooting, Talib engaged in violence. However, I just understand that all facts are not yet known, and that Billings could have been up to no good as well. If it turns out that Talib only struck Billings because the man was being aggressive and Talib considered him a threat, then it would have been justified by law.

    2. I never once addressed that, so I do not see how you can make that claim about me. Regardless, a person cannot be tried for crimes the authorities think he might commit in the future. Future crimes are not the issue…the current crime is. And the past incidents have already been dealt with.

    I just believe this incident should be judged on it’s own merits, once the facts are known.

    I’m not a big fan of control, but I am a fan of idiot control, and it sure would be nice if people had to demonstrate their ability to use a gun before they were allowed to purchase one. I would have no problem being forced to go to a qualifying range every 5 years or so to maintain a gun license. One thing’s for sure with Aqib and his Mama is that the apple sure didn’t fall far from the tree. I can only imagine what Baby Aqib’s Daddy must have been like.

    Look, I agree with everyone that he probably cannot be trusted. We should almost definitely start working towards finding a replacement. However, I don’t see why there should be a rush to judgment. What if (and I know this is a big what if and highly unlikely) we later find out he is truly innocent, but we have already cut him? We just simply don’t know the facts. It’s not even known whose house it happened at. I think this situation in particular deserves time to play out, because we are dealing with the safety of his family. Most men would do anything they can to protect their family, so I give him a little more of a pass as a result.

    Again, I am not saying he’s innocent or we should definitely keep him, but just let it play out a little before you want to end someone’s career. If he’s guilty, cut him and throw him in jail. But if he is not (however remote of a chance that is), then I still want him on this team. And yes, that is because he is good at football. Sorry folks, that’s the way the world works, no matter what career you are in.

    What’s going to happen is when a new CBA is signed, language will be included that Goodell’s powers of spanking players who misbehave will be retroactive to cover the period during the lockout.
